Proposal would create a new cabinet-level agency and governing board

State lawmakers are moving forward with legislation that would establish a new Department of Child Safety and Wellbeing and reorganize how Oklahoma delivers child welfare and juvenile services. The measure, Senate Bill 1570, has advanced in the Senate after being reported “do pass” with a committee substitute on Feb. 23, 2026, and is positioned for further consideration by the full chamber.

The current committee-substitute version of SB 1570 creates the Department of Child Safety and Wellbeing within state government, led by a commissioner and overseen by a nine-member governing board. The bill also sets a transition timeline that would shift major functions from existing entities into the new department.

What SB 1570 would change

Under the committee-substitute language, the powers and duties of the Child Welfare Services Division of the Oklahoma Department of Human Services would be transferred to the new Department of Child Safety and Wellbeing effective July 1, 2027. The bill also calls for the full transfer of the Office of Juvenile Affairs on the same date, including its employees.

The legislation further provides that, upon completion of the transfers, the Child Welfare Services Division within Human Services, the Office of Juvenile Affairs, and the Board of Juvenile Affairs would be abolished.

Governance: commissioner, interim leadership, and board appointments

The bill authorizes the governor to appoint an interim commissioner to carry out the transition plan until the board convenes and appoints a permanent commissioner. The commissioner would be appointed by, and serve at the pleasure of, the board and could be removed or replaced without cause under the bill’s provisions.

The nine-member board would be composed of five gubernatorial appointees, two appointees of the Senate president pro tempore, and two appointees of the House speaker. Initial board appointments would be required no later than Sept. 1, 2026. The commissioner would serve as an ex officio board member and could vote only to break a tie.

Member qualifications and ethics provisions

SB 1570 requires board members to include individuals with experience spanning fields such as social work, child welfare, children’s behavioral health, juvenile justice, criminal justice, education and related disciplines. The bill also includes eligibility requirements, including state residency and disqualification for felony convictions, and bars members from voting on issues where they have a direct financial interest.

The measure sets a governance framework in which the board appoints the commissioner, oversees agency activities, promulgates rules and reviews the annual budget request.

What happens next

As of Feb. 26, 2026, SB 1570 remains in the legislative process, with Senate action to follow. If enacted, the bill’s effective date is tied to passage and approval through an emergency clause, while the major operational transfers are scheduled for July 1, 2027, after a transition period that includes joint planning by agency leadership.
